Chapter 1, Section 5 – Enforcement and Penalty


1.5.01 General Statement

The town of Rockford has the right to enforce this ordinance by any legal means. These means include, but are not limited to, actions in the courts, whether criminal or civil in nature. These means include also administrative actions, including but not limited to the following: revocation of a license or permit; collection of a penalty or imposition of a fine; recovery of the costs of enforcement; or any combination of these actions.

1.5.02 Filing and Investigation of Complaints

Upon filing of a written complaint, the Town's compliance officer shall investigate the matter complained of and submit written findings to the Town Council.

1.5.03 Violations

The Town Council shall review the Compliance Officer's findings to determine whether this ordinance has been violated. If it determines that the ordinance has been violated, the Town Council or its attorney shall notify the violator. The notice shall specify a date after which the violator may be subject to a penalty if the violation continues. The notice shall also recite the penalty to which the violator may be subject if the violation continues.

1.5.04 Civil Penalty Clause

If the Town Council finds that a violation of this ordinance has occurred, the Council may fine the violator up to S1,000.00 for each such violation. Further, each day that a violation continues shall constitute a separate violation. As a result, if, for example, a violation occurs for three (3) days, the Council may fine the violator up to $3,000.00.
